The 'Beautiful' singer - who married Jordan Bratman in 2005 after dating him for three years - has cited 'irreconcilable differences' as the reason for the couple's split.
According to legal documents obtained by gossip website TMZ.com, the pair signed a prenuptial agreement prior to tying the knot, which will determine who gets what in the divorce settlement.
The petition - which lists the date of separation as September 11 2010 - requests that: 'Earnings and accumulations of Aguilera before marriage, during marriage and from and after the date of separation be considered separate property.'
It is believed the couple are seeking joint physical and legal custody of their two-year-old son Max.
Christina is being represented by powerhouse attorney Laura Wassel.
However, the petition states the 29-year-old singer will block any attempt made by her husband to receive child support from her.
The singer released a statement on Tuesday (12.10.10) confirming the pair had broken up.
She said: 'Although Jordan and I are separated, our commitment to our son Max remains as strong as ever.'
